Since 2017, Turkey has also adopted a new regulation for the management of chemicals that combines various legislative instruments into one and is largely based on the Reach Regulation: the KKIDIK.
The name corresponds to the first letters of the Reach written in Turkish:
Chemicals – Kimyasalların
Registration – Kaydı
Evaluation – Değerlendirilmesi
Authorization – İzni
Restriction – Kısıtlanması
The KKDIK provides for the pre-registration and registration of all chemicals produced or placed on the Turkish market, both as such and if contained in mixtures, for an annual volume equal to or greater than one ton.
The following are exempt:
– substances with an average annual tonnage of less than 1 ton;
– the substances covered by Annexes IV and V of the European Reach Regulation;
– items in transit, provided they are not processed (such as customs and free zones);
– polymers (but the monomers used in the production of the polymer are not exempted).
Pre-registrations and registrations can only be made by the Turkish importer or by an Exclusive Representative (OR – Only Representative) designated by the non-Turkish exporter.
Companies based outside Turkey are not allowed to submit registration dossiers for chemicals, however they can appoint an only representative established in Turkey to take over the duties and responsibilities incumbent on importers in order to ensure compliance with the Regulation.
DEADLINES
The pre-registration process started on 23/12/2017 and will end on 31/12/2020.
The registration process will start on 01/01/2021 and will end on 31/12/2023.
Companies that complete the pre-registration of their substances by 31 December 2020 will be able to benefit from a transitional period until 31 December 2023, otherwise they will be obliged to submit a complete registration dossier starting from 1 January 2021.
